Daily Stat Review app. Effective 23 October 2026.
These terms are a binding agreement between you and Shukie LLC, a Florida limited liability company, 7901 4th St N STE 300, St. Petersburg, FL 33702, USA ("we", "us", "our"), governing your use of the Daily Stat Review iOS app.
The free Daily Stat Review email service is a separate service with its own terms.
By downloading, accessing or using the app you accept these terms. If you do not accept them, do not use the app.
Section 12 contains an agreement to arbitrate and a waiver of class actions and jury trial. Please read it.
1. Who may use the app
You must be 18 years of age or older and able to form a binding contract. The app is intended for clinicians and clinical trainees.
You are responsible for your Apple Account and for anything done through it in the app. It is the only route into your account, because we do not collect a password or an email address, and we collect a name only from residents whose program pays for their access.
2. What the app is
The app presents one Internal Medicine question each day, with an explanation available after you commit to an answer. It records what you answered and reports what that accumulates to over time: accuracy, streaks, areas of weakness, and optional leagues with other users.
3. Medical and Educational Use Disclaimer
3.1 The app is an educational self-assessment tool. It does not provide medical advice, diagnosis or treatment, and it is not a clinical decision support tool.
3.2 Questions and explanations describe general clinical topics for study. They do not concern any actual patient, they are not tailored to any clinical situation, and they must not be used to diagnose, treat, or make any decision about the care of any person.
3.3 No professional relationship is created. Using the app does not create a physician-patient relationship, a consulting relationship, or any professional or fiduciary relationship between you and us, or between you and any author or contributor.
3.4 The app is not a medical device. It is not intended to diagnose, cure, mitigate, treat or prevent any disease. It has not been reviewed, cleared or approved by the United States Food and Drug Administration or by any other regulatory authority, and no such review is claimed or implied.
3.5 Content may be incorrect, incomplete or out of date. Medicine changes, sources conflict, and errors occur. We do not warrant that any question, answer, explanation or reference is accurate, current, complete or appropriate for any purpose. You must independently verify anything before it informs patient care.
3.6 Your professional judgement is yours alone. You are solely responsible for every clinical decision you make. Nothing in the app substitutes for your own training, judgement, the standard of care, institutional policy, or the guidance of a supervising clinician.
3.7 Assumption of risk. You acknowledge that any use of the content is at your sole risk, and you accept full responsibility for any consequence of relying on it.
3.8 No examination or credentialing claim. Using the app does not prepare you for, predict, improve, or guarantee any result in any examination, certification, licensure or credentialing process. We make no such claim, and any statement of that kind, from any source, is unauthorised.
3.9 No affiliation. We are not affiliated with, endorsed by, sponsored by, or connected to any examining board, certifying body, specialty society, medical school, hospital or health system. A residency program that pays for your access is our customer, not our partner, and does not endorse or review the app's content. Any name referenced is used descriptively only.
3.10 Not a substitute for required education. The app is not accredited continuing medical education and confers no credit of any kind.
3.11 Not for emergencies. The app must never be used in a medical emergency or in any situation requiring urgent clinical action. In an emergency, contact your local emergency services.
3.12 If you do not accept this section in full, do not use the app. Your use of the app is your acceptance of it.
4. Your account and your record
You choose a display name (a nickname) when you start, and you can change it once every 30 days. It does not need to be your real name, and we do not ask for your real name, with one exception: if a residency program pays for your access, you give the name your program knows you by (sections 5.11 to 5.14). Other members of any league you join see your display name, together with your accuracy and your average time. A league name you create is seen by anyone with its invite and, for a public league, by anyone who searches.
You may delete your account and everything in it at any time in Settings. Our Privacy Policy explains what deletion removes and the one thing it does not.
5. Subscription, billing and cancellation
5.1 Access requires a paid subscription, billed monthly through your Apple Account, unless a residency program pays for it (5.11).
5.2 The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the period ends.
5.3 Cancel in your Apple Account settings. We cannot cancel a subscription for you, because Apple does not permit it.
5.4 Refunds are administered by Apple, not by us. All purchases are final except where this section or the law says otherwise. Direct any refund request to Apple, at reportaproblem.apple.com; we have no technical ability to refund a purchase billed by Apple. Cancelling part way through a period does not entitle you to a partial or prorated refund. We do not refund unused time, dissatisfaction with the content, its difficulty, format or accuracy, a change of mind, or any period during which access was suspended for breach of these terms.
5.5 Renewal timing. Your subscription renews on the same calendar date each period as your original purchase. Where a month does not contain that date, it renews on the last day of that month.
5.6 Free trials and introductory pricing. If we offer a free trial or an introductory price, it converts to the then-current full price automatically at the end of the introductory period unless you cancel beforehand. We are not obliged to remind you, though we may choose to. Cancelling in time is your responsibility.
5.7 Price changes. We may change prices prospectively. Where the law requires it we will give advance notice, generally at least 30 days, before a new price applies to a renewal, and Apple will seek your agreement where it requires that. No change affects a period you have already paid for.
5.8 Failed payments. If a renewal payment fails, Apple may retry it and we may suspend your access until it succeeds. If it cannot be processed within a reasonable period your subscription may be cancelled and access ended.
5.9 Chargebacks. Starting a chargeback or payment dispute without first contacting us in good faith may result in immediate suspension or termination of your account, without refund, in addition to any other remedy available to us, including recovery of the disputed amount and any associated fees.
5.10 Cancelling ends your access at the end of the period you have paid for. It does not delete your record, which stops updating. Cancelling is not the same as deleting your account; if you want your data removed, delete the account in Settings.
5.11 Access paid for by a residency program. A residency program may pay for your access. You join by entering the code it gives you. You are not charged, and sections 5.1 to 5.10 do not apply while your program covers you.
5.12 Your program sees your results. Joining a program is your instruction to us to send your program director a monthly summary with your name and results, as our Privacy Policy describes. Your program director may share it within your program, such as with chief residents or faculty. Access paid for by a program is not anonymous.
5.13 When program access ends. It ends when your program's access expires, normally on 30 June, or earlier if your program removes you. Your record stays yours. To keep using the app after that, subscribe.
5.14 Your program's use of your results. How your program uses your results is between you and your program. We do not control it, and we are not a party to any arrangement between you and your program.
6. Licence, and what you may not do
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and its content for your own individual study. All other rights are reserved.
The questions, explanations, text, design and software are owned by us or our licensors and are protected by copyright and other laws. You may not:
- copy, reproduce, republish, sell, licence, rent, distribute or publicly display any content, in any medium
- share your account, or allow anyone else to use it
- scrape, harvest, bulk download, index, or access the app by any automated means
- use any content to train, fine tune, evaluate or develop any machine learning or artificial intelligence system;
- reverse engineer, decompile or disassemble the app, or attempt to access data that is not yours
- circumvent any limit, timer, gate or security measure
- use the app unlawfully, or to harass, abuse or impersonate anyone
- submit anything unlawful, abusive, infringing, or containing information about an identifiable person.
We may suspend or terminate your access immediately for any breach of this section.
7. Leagues and other users
Leagues are voluntary and are between you and the members. Display names and league names must not be offensive, sexual, hateful or threatening, must not pretend to be anyone else (including us, Apple or any exam body), and must not contain contact details. We do not tolerate objectionable names. Any user can report a name in the app. We act on reports, and we may remove or replace any name, stop you from changing yours, or suspend your access, without notice. We provide no messaging, and we are not responsible for the conduct of any user. You use leagues at your own risk.
8. Feedback
If you flag a question or send us feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, including improving the app, without attribution, obligation or payment.
Do not send us anything confidential, and do not send us any information about an identifiable patient. You are responsible for ensuring you do not.
9. Availability and changes
We aim to keep the app working. We do not guarantee that it will be available, uninterrupted, or error free, or that a question will be published on any given day. We may add, change, suspend or withdraw any feature at any time.
10. Termination
You may stop at any time by cancelling your subscription and deleting your account. We may suspend or terminate your access at any time, with or without notice, for breach of these terms or if we cease offering the app. Sections 3, 6, 8, 10, 11, 12, 13 and 16 survive termination.
11. Disclaimers and limitation of liability
11.1 THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law we disclaim all warranties, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or usage of trade.
11.2 To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, professional opportunity or reputation, however caused and on any theory of liability, even if we have been advised of the possibility.
11.3 To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these terms or the app is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars.
11.4 Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limits above apply to you only to the extent permitted, and our liability is limited to the smallest amount the law allows.
11.5 You agree that the limits in this section are a fundamental basis of the bargain between us, and that we would not provide the app without them.
12. Disputes, arbitration, and waiver of class actions
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
12.1 Informal resolution first. Before starting any proceeding, you agree to contact us at admin@medboarddaily.com and give us 60 days to resolve the dispute informally. Most matters end here.
12.2 Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to these terms or the app will be resolved by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section.
12.3 Exceptions. Either of us may bring an individual claim in small claims court, and either of us may seek injunctive relief in court to protect intellectual property.
12.4 Class action and jury waiver. You and we each waive any right to a jury trial, and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. An arbitrator may not consolidate claims or preside over any form of representative proceeding.
12.5 Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing admin@medboarddaily.com with your account's display name and the words "arbitration opt-out". Opting out affects nothing else in these terms, and we will not hold it against you.
12.6 If the class waiver in 12.4 is found unenforceable, the whole of this section 12 is void and disputes proceed in the courts identified in section 13. The rest of these terms survive.
12.7 Time limit. To the fullest extent permitted by law, any claim must be brought within one year of when it arose, or it is permanently barred.
13. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Where section 12 does not apply, you and we submit to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida, and waive any objection to that venue.
14. Indemnity
You will indemnify, defend and hold harmless Shukie LLC and its members, officers, contractors and agents from any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or relating to: your use of the app; your breach of these terms; any clinical decision you make or any reliance you place on the content; your infringement of any right of another; or anything you submit to us.
15. Apple
15.1 These terms are between you and Shukie LLC only, not with Apple. Apple is not responsible for the app or its content.
15.2 Apple has no obligation to furnish any maintenance or support for the app.
15.3 If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
15.4 Apple is not responsible for addressing any claim by you or any third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
15.5 Apple is not responsible for the investigation, defence, settlement or discharge of any third party claim that the app or your use of it infringes that third party's intellectual property rights.
15.6 You represent that you are not located in a country subject to a United States Government embargo or designated as terrorist supporting, and that you are not on any United States Government list of prohibited or restricted parties.
15.7 Apple and its subsidiaries are third party beneficiaries of these terms, and upon your acceptance Apple has the right to enforce them against you as a third party beneficiary.
16. General
Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the app and replace anything said before.
Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the rest remains in force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition or sale of assets.
Force majeure. We are not liable for any failure caused by anything beyond our reasonable control.
Changes. We may update these terms. For any material change we will give notice in the app before it takes effect, and your continued use afterwards is acceptance.
